These Terms & Conditions apply to purchases made through our website and should be read together with our Shipping & Delivery Policy, Returns, Cancellations & Refunds Policy and Privacy Policy.

Nothing in these Terms affects your statutory rights as a consumer.

By placing an order through our website, you agree to these Terms & Conditions.

Please read them carefully before placing an order.

You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.

We may update these Terms from time to time. The Terms that apply to your purchase will be those in force when your order is placed. Changes made afterwards will not retrospectively change your existing contract unless required by law or expressly agreed with you.

3. Products & Product Information

We take reasonable care to ensure that product descriptions, specifications, dimensions, images and prices displayed on our website are accurate.

Product images are for illustration purposes. Colours and finishes may appear slightly different depending on lighting, photography and the display settings of your device.

Where dimensions are provided, reasonable manufacturing tolerances may apply where appropriate.

We may update product information or discontinue products from time to time.

Goods supplied by us must be as described, of satisfactory quality and fit for purpose where required by law.

If information provided by ESE Bathrooms about a product is incorrect or misleading and this causes the product not to conform to the contract, your statutory rights are unaffected.

4. Installation & Compatibility

Bathroom and kitchen products can have specific installation requirements.

Before ordering, you are responsible for checking that the product is suitable for your intended installation, including, where relevant:

  • dimensions and available space;

  • plumbing and waste connections;

  • water supply requirements;

  • electrical requirements;

  • installation clearances;

  • wall, floor or mounting requirements; and

  • any other relevant compatibility requirements.

If you are unsure, we strongly recommend confirming suitability with a suitably qualified installer before placing your order.

Where the product supplied is correct and as described but cannot be installed because the dimensions, connections or other conditions at your property are unsuitable, this will not normally mean that the product is faulty.

If you are entitled to return such a product under your statutory cancellation rights, it will normally be treated as an unwanted return and the applicable return costs will be dealt with under our Returns, Cancellations & Refunds Policy.

This does not apply where incompatibility results from incorrect or misleading product information supplied by ESE Bathrooms.

Please inspect products before installation. Do not install or attempt to install a product that you believe is damaged, incorrect or defective. Contact us first.

We are not responsible for faults or damage caused by incorrect installation, misuse, accidental damage or unauthorised alteration. This does not affect your statutory rights where goods were faulty or non-conforming when supplied.

5. Prices & Payment

All prices displayed on our website are in pounds sterling (GBP).

The total price payable, including applicable delivery charges, will be displayed before you complete your order.

Payment must be made using one of the payment methods offered at checkout.

Prices and availability may change from time to time, but changes will not affect an order after a contract has been formed except where permitted by law or agreed with you.

If we discover an obvious pricing or product information error before accepting your order, we will contact you and give you the option to proceed at the correct price or cancel the order.

If we cannot contact you, we may cancel the affected order and refund any amount you have paid.

Nothing in this section allows us to change an agreed price after a contract has been formed simply because we later decide to increase the price.

6. Placing an Order & Contract Formation

When you place an order through our website, you are making an offer to purchase the goods shown in your order.

You will receive an electronic acknowledgement confirming that we have received your order.

Receipt of an order acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and ESE Bathrooms is formed when we confirm acceptance of your order or dispatch the goods to you, whichever occurs first.

We reserve the right to decline an order before it has been accepted for legitimate reasons, including where:

  • a product is unavailable;

  • payment cannot be authorised;

  • there is an obvious pricing or product information error;

  • delivery to the requested location is unavailable;

  • we reasonably suspect fraud or misuse; or

  • applicable law prevents us from fulfilling the order.

If we cannot accept an order after payment has been taken, we will refund the amount paid for the affected goods.

7. Product Availability

All orders are subject to product availability.

We make reasonable efforts to keep stock information accurate, but occasionally an item may become unavailable after an order has been placed.

If this happens, we will contact you as soon as reasonably possible and, where appropriate, offer available options such as waiting for stock, choosing an alternative or receiving a refund for the unavailable item.

We will not substitute a materially different product without your agreement.

8. Delivery

Our delivery areas, charges, estimated delivery times and arrangements are explained in our Shipping & Delivery Policy, which forms part of these Terms.

Standard UK mainland delivery is normally 3–5 working days, subject to product availability and the delivery information provided on our website.

Some large, heavy or fragile products may be delivered by pallet or specialist carrier and may be subject to access requirements.

You are responsible for providing an accurate delivery address and for informing us of relevant access restrictions.

Delivery times are estimates unless a specific delivery date has expressly been agreed.

Your statutory rights relating to late or failed delivery are unaffected.

9. Your Right to Cancel

If you are a consumer purchasing online, you will normally have a statutory right to cancel your order without giving a reason.

For most goods, you have 14 days from receiving the goods to tell us that you wish to cancel. After notifying us, you normally have a further 14 days to return the goods.

Certain statutory exceptions may apply, including to goods made to your specifications or clearly personalised.

Full details of cancellations, returns, return costs and refunds are contained in our Returns, Cancellations & Refunds Policy.

Nothing in these Terms limits your statutory cancellation rights.

10. Returns & Return Costs

If you exercise your statutory right to cancel because you have changed your mind, you will normally be responsible for the direct cost of returning the goods, where we have informed you of this as required by law.

This also applies where a product is correct and as described but is unsuitable because relevant dimensions, connections or installation requirements at your property were not checked before ordering.

Many products sold by ESE Bathrooms are large, heavy, fragile or palletised and cannot normally be returned through standard postal services.

For bulky goods that cannot normally be returned by post, the direct cost of a UK mainland return is estimated at up to approximately £80. The exact cost may depend on the size, weight, collection postcode and other transport requirements and can be confirmed before collection is arranged.

This does not apply in the same way where goods are faulty, damaged, incorrect, not as described or otherwise do not conform to the contract. In those circumstances, your statutory rights apply and we will bear reasonable return or collection costs where required by law.

11. Faulty, Damaged or Incorrect Goods

Goods supplied by ESE Bathrooms must meet the standards required by applicable consumer law.

If goods are faulty, damaged, incorrect, not as described or otherwise do not conform to the contract, please contact us as soon as reasonably possible.

We may reasonably ask you to provide photographs or other information to help us identify and investigate the problem.

Promptly reporting visible transit damage can help us make a claim against the carrier, but failure to report a problem within 24 hours does not remove your statutory rights.

Depending on the circumstances and when the problem is reported, you may be entitled to a refund, repair, replacement, price reduction or other remedy under the Consumer Rights Act 2015.

12. Refunds

Refunds will be handled in accordance with our Returns, Cancellations & Refunds Policy and applicable law.

Where you exercise an applicable statutory cancellation right, we will refund the amount due to you, including the cost of our least expensive standard delivery option where required by law.

If you selected a more expensive delivery method, we are not required to refund the additional cost above our standard delivery service.

Refunds will normally be made to the original payment method unless otherwise agreed.

13. Installers & Tradespeople

We strongly recommend that you do not book an installer or tradesperson until your goods have arrived and you have checked that they are correct, complete, undamaged and suitable for the intended installation.

We are not responsible for avoidable costs arising solely because a tradesperson was booked before the goods were received and reasonably checked.

However, nothing in this section excludes or limits liability that cannot lawfully be excluded, including your statutory rights where goods are faulty, not as described or otherwise do not conform to the contract.

14. Our Responsibility to You

We do not exclude or limit our liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • goods that are faulty, not as described or otherwise fail to meet statutory requirements; or

  • any other liability or consumer right that cannot legally be excluded or limited.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

If you are purchasing as a consumer, we supply products for private and domestic use. We are not responsible for business losses such as loss of profit, revenue or business opportunity arising from a consumer purchase, except where applicable law provides otherwise.

15. Events Outside Our Reasonable Control

We will not be responsible for delay or failure to perform our obligations where this results from circumstances outside our reasonable control.

If such an event significantly affects your order, we will take reasonable steps to minimise the impact and will contact you where appropriate.

Nothing in this section removes any statutory right you may have to cancel or receive a refund where applicable.

16. Website Use & Intellectual Property

The content of this website, including text, graphics, branding, design and other materials owned by ESE Bathrooms, may not be reproduced, distributed or commercially exploited without our permission, except where permitted by law.

You must not knowingly misuse the website, introduce malicious software, attempt unauthorised access or use the website for unlawful purposes.

We do not guarantee that the website will always be available without interruption. Temporary suspension for maintenance, technical reasons or circumstances outside our control may occasionally be necessary.

Our website may contain links to third-party websites.

These links are provided for convenience or additional information. We do not control third-party websites and are not responsible for their content, availability or privacy practices.

Any purchase or agreement entered into directly with a third party will be subject to that third party's own terms.

If you are a consumer resident elsewhere in the United Kingdom, you will also retain the benefit of any mandatory consumer protections that apply to you in the part of the UK where you live.

Nothing in these Terms limits your right to bring proceedings in a court that has jurisdiction under applicable consumer law.

Your statutory rights are unaffected.

We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.

Any changes will apply to future orders from the date the updated Terms are published. They will not retrospectively change the Terms applying to an existing order unless required by law or expressly agreed with you.
